* * * * Appellant, herein, filed a petition under Section 13-B of the Hindu Marriage Act, which was dismissed by the learned District Judge, Kapurthala. Hence, this appeal at his instance.
Learned counsel for the parties submit that during the pendency of the appeal, the parties have settled the matter amicable and they have already filed a joint petition seeking divorce under Section 13-B of the Hindu Marriage Act. The petition has already been entertained by the Trial Court and is now listed on 10.08.2016 for making final statement. A photocopy of the petition filed under Section 13-B is taken on record. In this view of the matter, counsel for the parties have agreed that this appeal be consigned to record having been settled. Both the counsel, however, submit that in case, the mutual divorce petition fails, they will have a right to recall this order.
