G.S.SANDHAWALIA, J. (Oral) Admittedly, the dismissal order has been passed by the Director, Health and Family Welfare-respondent no. 2 on 19.03.2012 (Annexure P-2) on the strength of the conviction recorded against the petitioner. The grouse of the petitioner is that the issue as to whether the conviction and the sentence which was awarded fell within the ambit of moral turpitude or not was never considered. The said respondent was thereafter again approached by way of legal notice, which has now been rejected on 25.11.2013 (Annexure P-4).
Counsel for the petitioner could not dispute the fact that an appeal would lie to the State Government, which has not been preferred. Faced with the circumstances, counsel does not press the present petition and prays for withdrawal of the same with liberty to approach the Appellate Authority within a period of 4 weeks from today. Ordered accordingly.
