Present writ petition is challenge to the award dated 18.07.2017 (Annexure P1) whereby petitioner was ordered to be reinstated on the same post with continuity of service within 15 days from the date of passing of the award and to pay lump-sum compensation of Rs.35,000/-. As per learned counsel for the petitioner, petitioner was taken back in the employment but he has not been awarded continuity of service, though he has already received payment of Rs.35,000/-. In view of above, present writ petition is not maintainable as claim of the petitioner has been accepted by the learned Industrial Tribunal and writ petition is accordingly disposed of. However, petitioner shall be at liberty to file execution petition for execution of the award (Annexure P1) before the concerned Court.
