IN THE HIGH COURT OF PUNJAB AND HARYANA AT
CHANDIGARH CWP No.4526 of 2016 Date of decision:07.04.2016 William

Versus
State of Punjab and others
...Respondents
CORAM: Hon'ble Mr. Justice Rakesh Kumar Jain
Present:
Mr. Sandeep Arora, Advocate, for the petitioner.
***** Rakesh Kumar Jain, J.
The petitioner is aggrieved against the order dated 15.02.2016 by which it has been held that the petitioner does not fulfill the condition for grant of benefits under the Indira Awas Yozna. Counsel for the petitioner has submitted that the house of the petitioner is a kuchha house, whereas the finding recorded in the impugned order is that "BDPO, Gurdaspur through his letter No.759 dated 05.04.2011 had reported that as per the report of the Panchayat Secretary, house of the petitioner in village is pucca and his name is not entered in the BPL/IAY waiting list". It is also observed that as per office record, the petitioner till date has not been granted any grant under the Indira Awas Yozna for the construction of the house because neither his name has been included in the BPL list nor any BPL card has been issued to him. Thus, there is no error in the impugned order dated 15.02.2016 for the purpose of interference by this Court and hence, the present petition is hereby dismissed being denuded of any merit.
