**** CR-4762-2026 Date of decision: 01.07.2026 Annu Bhalla @ Anita and others . . . . Petitioners Vs.

Somnath (since deceased) through his LRs . . . . Respondents ****

CORAM:

HON'BLE MR JUSTICE DEEPAK GUPTA **** Present: - Mr.Manmohan Saroop, Ms.Meenakshi Saroop, Advocates, for Mr.Chander Shekhar, Advocate, for the petitioners. **** DEEPAK GUPTA, J. (ORAL) Petitioners herein are the decree-holders in execution petition bearing EXE No.61 of 2024 titled Annu Bhalla and others Vs. Som Nath, pending before learned Civil Judge (Jr. Division), Karnal. 2.

By way of this petition filed under Section 227 of the Constitution of India, they pray for issuing direction to the concerned executing Court to execute the final decree dated 05.01.2024, expeditiously. 3.

Learned counsel submits that though the execution was filed way back in 13.03.2024 but due to filing of frivolous objections by the JDs, the execution petition has not been disposed of till date and the matter is lingering on.

4.

Without commenting anything on the merits of the case, the concerned Executing Court is directed to take effective steps for disposing of the execution petition as referred above, expeditiously by keeping in view the directions issued by Hon'ble Supreme Court in Rahul S. Shah Vs. Jinendra Kumar Gandhi, (2021) 6 SCC 4518.

The petition is disposed of accordingly.
