This criminal writ petition has been filed under Article 226 of the Constitution of the India for issuance of directions to respondent Nos.1 to 3 for protection of life and liberty of the petitioner at the hands of private respondent Nos.4 to 8.

Learned counsel for the petitioner would contend that a complaint was given to the official respondents on 22.07.2023, however, no action has been taken qua the same.

On the asking of the Court, Ms. Mahima Yashpal, DAG Haryana accepts notice on behalf of respondent Nos.1 to 3. 2023:PHHC:098699 CRWP-7553-2023 (O&M) -2occurrence is 22.07.2023, and the complaint has been registered as complaint No.924-ADGP, 296-5D, dated 31.07.2023. Learned counsel has further pointed out that infact an FIR was lodged against the petitioner on 23.07.2023 by respondent No.5 being FIR No.331 dated 23.07.2023 under Sections 147, 149, 323, 324, 427 and 506 of the Indian Penal Code, 1860 and Sections 25-54-59 of the Arms Act, 1959 registered at Police Station Sadar Taura, Mewat. On investigation it was found that the petitioners had caused damage to the government vehicles as also to the JCB machine which was being used for laying down wires after partition had been effected. Injuries were also given to respondent Nos.4 to 8. Learned State counsel on instructions would further state that the complaint which has been filed yesterday would nevertheless be looked into and investigated. 5.
In view of the above, without commenting on the merits of the case, the present petition is disposed off with a direction to respondent No.2 - Superintendent of Police, Nuh-Mewat, Haryana - to look into the representation dated 22.07.2023 (Annexure P/2) and take necessary action, if required, in accordance with law. Pending applications, if any, also stand disposed off.
