JUSTICE GURVINDER SINGH GILL Present:- Mr. Narender Kaajla, Advocate for the petitioner. ***** GURVINDER SINGH GILL, J.(Oral) The petitioner stands convicted vide order dated 3.3.2016 pursuant to judgment dated 2.3.2016 passed by learned Sub Divisional Judicial Magistrate, Hansi for having committed offence punishable under Section 509 of Indian Penal Code and sentenced to undergo rigorous imprisonment for 6 months and to pay fine amounting to `500/-. An appeal filed by him challenging aforesaid judgment dated 2.3.2016 and order of sentence dated 3.3.2016 also stands dismissed vide order dated 1.8.2019 passed by learned Additional Sessions Judge, Hisar. I have heard the learned counsel for the petitioner to consider the propriety of sentence.

The petitioner is a young man aged 29 years and is not stated to be a previous convict. He has undergone about one month of imprisonment out of the imposed sentence of six months. Having regard to the nature of allegations and the age of the petitioner and also that he is stated to be first offender, the substantive Pankaj Kakkar 2019.08.

( 2 ) CRR-2009-2019 (O&M) sentence of imprisonment as imposed upon the petitioner in respect of offence under Section 509 IPC is reduced from 6 months to the one already undergone subject to the conditon that the petitioner pays an amount of `1 lac as compensation to the victim. The said amount shall be deposited by the petitioner before the trial Court. The said amount, upon being deposited, shall be disbursed to the victim by the trial Court. The petition stands disposed of with aforesaid modification in sentence.
