The petitioner apprehending arrest in the FIR captioned above has come up before this Court under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023, [BNSS], seeking anticipatory bail.

Per para 9 of the short reply, all the offences are bailable and the present petition is not maintainable.

Given above, the present petition is disposed of. In case, any non-bailable offence is added, then petitioner be given 07 working days prior notice in this regard. It is clarified that if Section 106(2) BNS is notified, it shall be permissible for the petitioner to appear before the trial Court and the trial Court shall release him on bail on the same day.
