Petitioner (Vinod Kumar) has filed the present writ petition under Articles 226/227 of the Constitution of India seeking quashing of award dated 03.01.2013 (Annexure P-4) whereby the application (Annexure P-1) moved by the petitioner under Section 33-C-(2) of the Industrial Disputes Act, 1947 has been disposed of. A further prayer has been made for directing respondent No.2 to pay the financial dues to the petitioner, as claimed by him in his aforesaid application (Annexure P-1), alongwith the interest and all consequential benefits. 2.
A perusal of file reveals that on 07.12.2022, the following order was passed by this Court:
"As per the office report, respondent No.2 has expired. The counsel appearing for the petitioner seeks adjournment to bring on record the legal representatives of respondent No.2. Adjourned to 27.07.2023."

Thereafter on 27.07.2023, learned counsel for the petitioner sought another accommodation to comply with the aforesaid order dated 07.12.2022. However, the same has not been complied with till date. 4.
Today, there is no representation on behalf of the petitioner. It appears that the petitioner is not interested in pursuing the present writ petition any further.

Keeping in view of the above, the writ petition is dismissed for nonprosecution. 6.
