-.- JAISHREE THAKUR J. (ORAL) The instant writ petition has been filed under Article 226/227 of the Constitution of India for issuance of a writ in the nature of mandamus, directing the respondents to allot paddy for custom milling to the petitioners.

Learned counsel appearing for petitioners would contend that petitioners are to be allotted paddy in terms of custom milling policy 20222023, however, the same is not being allotted. Pursuant to notice of motion order having been issued, short reply by way of affidavit of Ravinder Kaur, District Controller, Food, Civil Supplies & Consumer Affairs, Patiala on behalf of respondents No.1, 2 and 4 has been filed, which is taken on record.

As per the reply filed, it is submitted that the petitioner-mill has been blacklisted and once it is blacklisted, it would be deemed to be a defaulter and not entitled to allotment of any paddy under the said policy. CWP No.19712 of 2022 (O&M) -2Learned counsel appearing for respondent No.3 would argue that in fact, there is a dispute between the parties and an arbitrator has been appointed.

In view of the reply filed, learned counsel appearing on behalf of the petitioners does not press the instant petition seeking liberty to challenge the order whereby the petitioner-mill has been blacklisted.
