(ORAL) The Petitioners have preferred this writ petition for the issuance of a writ in the nature of mandamus directing the respondents to grant benefit of selection grade to the petitioners w.e.f. 01.01.1996 instead of 01.08.2000.

In view of the written statement filed by the respondents No.1 and 2, claim of the petitioner No.1 has been found to be genuine. Accordingly, petitioner No.1 has been held entitled for grant of selection grade w.e.f. 01.01.1996 instead of 01.08.2000. The benefit has been granted to the petitioner No.1 vide letter dated 05.07.2019 passed by the Competent Authority. CWP No.24104 of 2018(O&M) -2order has been passed on 05.07.2019 by the Competent Authority that the petitioner No.2 is not entitled for grant of selection grade because as per order dated 20.02.2017 passed in CWP No.9347 of 2016 titled Jagat Singh vs. State of Haryana and others, the selection grade was to be given w.e.f. 01.01.1996 only to those employees who were granted selection grade w.e.f. 01.08.2000. The specific order passed in this regard has been attached as Annexure R-1 along with written statement.

Since the order declining the relief qua petitioner No.2 has come into existence and the petitioner No.2 has not assailed the same in this writ petition, therefore this writ petition is disposed of with liberty to the petitioner No.2 to assail the order/letter dated 05.07.2019 in accordance with law. So far as petitioner No.1 is concerned, this writ petition has been rendered infructuous.

This petition is disposed of.
