The prayer in the present petition filed under Section 482 Cr.P.C. is for quashing of FIR No.126, dated 25.11.2013 registered under Sections 406, 420 IPC at Police Station Raikot, District Ludhiana (Rural) and for quashing of order dated 25.05.2017 passed by the learned Judicial Magistrate Ist Class, Jagraon, whereby the petitioners were declared proclaimed offenders in the aforementioned FIR. 2.

On 20.07.2023, the following order was passed:- The prayer in the present petition is for quashing of FIR No.126 dated 25.11.2013 under Sections 406, 420 IPC registered at Police Station Raikot, District Ludhiana Rural (Annexure P-1) and order dated 25.05.2017 passed by the Trial Court, Jagraon (Annexure P-7) whereby the petitioners had been declared proclaimed offenders.

The learned counsel for the petitioners contend that two co-accused of the petitioners stand acquitted and a compromise has been arrived at between the parties for which a petition bearing CRM-M-32121-2022 has been filed and the VIKAS CHANDER 2023.09.29 15:33 I attest to the accuracy and integrity of this document

CRM-M-44637-2021 -2- 2023:PHHC:127087 statement of the petitioners stand recorded. He states that the petitioners are ready and willing to join the proceedings. In view of the above, the operation of the order dated 25.05.2017 (Annexure P-7) shall remain stayed and the petitioners are directed to surrender before the Trial Court within a period of four weeks from today and subject to a deposit of Rs.1,00,000/- each as costs with the Institute for the Blind, Sector 26, Chandigarh, alongwith their passports, they shall be admitted to interim bail to the satisfaction of the Trial Court.

Adjourned to 26.09.2023.

Separate copies of the receipts with regard to deposit of Rs.1,00,000/- each by the petitioners as costs as well as a copy of the zimni order(s) of the Trial Court granting interim bail to the petitioners be placed/produced on the record on the next date of hearing."

In terms of the aforementioned order, the petitioners have returned back to India, surrendered themselves and have since been released on bail, after a sum of Rs.1,00,000/- each as costs was deposited by them with the Institute for the Blind, Sector-26, Chandigarh. 4.

In view of the above, no further orders are required to be passed by this Court in this regard. However, the passports of the petitioners which had been ordered to be surrendered in terms of the aforementioned order dated 20.07.2023, be returned to the petitioners immediately against proper receipt.
