Prayer is for grant of regular bail in case FIR No.243 dated 15.09.2018 under Sections 406,420,120-B IPC registered at P.S City Kharar, District SAS Nagar.
As per allegations, the petitioner in connivance with co-accused had duped the complainant of Rs.28,60,000/-.
Learned counsel for the petitioner contends that the petitioner has been falsely involved in the present case and that it is a matter of civil dispute. He submits that the petitioner has been suffering from various ailments and is under treatment from PGI, Chandigarh. In this regard, he has also annexed medical reports (P.3).
Opposing the petition, the learned State counsel has submitted that the challan has been presented in this case, charges have been framed and the trial has commenced. He has filed custody certificate of the petitioner accompanied by his Medical Report. As per the Medical Report of the petitioner sent by Medical Officer, New District Jail, Nabha duly attested by the Superintendent, New District Jail, Nabha, it is evident that the petitioner is a known case of Parkinsons disease, Diabetes mellitus type-2 and is on insulin 24 units, Hypertension. He has been taking treatment from PGI, Chandigarh for last 7 months. There has been deterioration in health, loss of weight, abnormal sugar levels, abnormal kidney function tests. Considering the medical condition of the petitioner and without commenting anything on the merits of the case and also bearing in mind the custody period of the petitioner besides the fact that he is not wanted in any other case, in my opinion, no useful purpose will be served by detaining the petitioner behind bars any further. The petition, as such, is accepted. The petitioner Parshotam Singh is ordered to be released on bail on her furnishing bail bonds/surety bonds to the satisfaction of learned trial Court/Chief Judicial Magistrate/Duty Magistrate concerned. However, in case the petitioner indulges in any activity akin to one for which he has been convicted, while on bail, the prosecution agency will be at liberty to seek the cancellation of the order granting bail to the petitioner.
