(ORAL) Prayer in the present petition is for issuing directions to respondent No.2-Director General of Police, Punjab to constitute a SIT headed by an IPS Officer in case FIR No.77 dated 07.09.2017 under Sections 302,473,148,149,120-B/201 IPC read with Section 25/54/59 of Arms Act registered at P.S Banur, District Patiala and to conduct investigation against the accused against whom final report had been delayed notwithstanding that the accused are notorious gangsters.
Learned counsel for the petitioner fairly submits that the present petition has been rendered infructuous insofar as other substantive grievances espoused with this petition are concerned and the same survives only with respect to initiating disciplinary & departmental action against the police officials who did not file final report within the prescribed period.
#2 Learned counsel representing the respondents-State has referred to affidavit dated 28.03.2023 of Surinder Mohan, PPS, DSP, Sub- Division Rajpura, District Patiala filed on behalf of respondent Nos.1,2,4 & 6, as per which the Department has taken action against the erring police officials and after issuing a show cause notice, a punishment of admonition has been ordered on 05.11.2019 by the then D.S.P.
Learned counsel appearing for the petitioner, however, submits that the punishment awarded is rather lenient and does not commensurate with the laxity shown by the employees. He, however, does not dispute the fact that the said order of admonition passed on 05.11.2019 is not subject matter of challenge in the instant petition and that he will have remedy of impugning the same. In the light of aforesaid facts, learned counsel for the petitioner does not press this petition with respect to other reliefs and seeks liberty to challenge the order dated 05.11.2019 of admonition passed by the S.S.P, Sangrur against the erring police officials before the appropriate competent Authority. Learned counsel for the respondents has no objection to the same. Disposed of as having not been pressed.
