 By these two petitions, filed under the provisions of Section 439 of the Cr.P.C, each petitioner seeks the concession of 'regular bail', upon FIR no.253, dated 19.08.2020, having been registered at Police Station Tripuri, District Patiala, alleging therein the commission of offences punishable under the provisions of Sections 353/186/332/333/148/149 of the IPC, with Section 307 thereof deleted and Section 308 thereof added subsequently in the FIR.

Though no reply of the respondent State is on record, learned State counsel submits that he has received the same and as per his instructions, it has been actually filed.

210/2 CRM-M-39360 of 2020 -2Be that as it may, he submits from the said reply that the injured suffered three injuries one of which is was declared to be dangerous to life, there being a depressed fracture on the parietal bone. Upon query, he submits that out of 23 prosecution witnesses, only one has been examined so far, with both the petitioner stated to be in custody for the past 6 months.

That being so, without making any comment on the merits of the case, these petitions are allowed, with the petitioners ordered to be enlarged on bail, upon their furnishing adequate bail and surety bonds to the satisfaction of the learned trial court/Chief Judicial Magistrate/Duty Magistrate concerned.

A copy of this order be placed on the file of the other connected matters too.
