Petitioner is seeking issuance of a writ in the nature of certiorari for setting aside selection list dated 27.10.2014 (P-6) issued by respondent No. 2 Vide advertisement No. 1/2012, respondent No. 2 advertise post of Lab Attendant and qualification for the post of Lab Attendant was 10+2. The criteria was that the applicant who scored 70% and above in 10+2 will be awarded 20 marks, 60% to 69%-18 marks and who secured below 60% marks in 10+2 will be awarded 16 marks. In written test, who candidate who will get 60% and above will be awarded 20 marks, 50% to 59%-18 marks and candidates who will secure below 50% marks will be awarded 16 marks and 01 mark was kept for the candidates who were having higher qualification. The precise grievance of the petitioner before this Court is that he applied for the above post and secured 61 marks in the written test and was called for interview on 02.07.2014. He answered all the queries put by the selection committee but was not selected and the candidates who secured must less marks than him have been selected because as per the information received under the RTI Act, the candidates who secured 50 marks in the written test, they have been awarded higher marks in the interview whereas the petitioner who secured 61 marks in the written test has been awarded only 02 marks. The writ petition is liable to be dismissed as the petitioner has participated in the selection process and was awarded marks as per the criteria laid down by the Selection Committee.

The petitioner cannot challenge the selection process only on the sole ground that he has been given lower marks in the interview as it is upon the Selection Committee to judge each and every candidate. If the petitioner has secured higher marks in the written test, it does not entitle him to be selected for the post.
