The present petition has been filed by the petitioner under Articles 226/227 of the Constitution of India, seeking a writ of mandamus, directing the respondents to treat the resignation of the petitioner dated 19.10.2022 (Annexure P-12) as a technical resignation, since the same was tendered only to enable the petitioner to join another government post and not to abandon service; to grant the petitioner continuity of service and pay protection by counting the service rendered at respondent No.3-College and to grant the petitioner the benefit of old pension scheme, as she was selected through Punjab Public Service Commission in the year 2002, which is prior to the cutoff dated 01.01.2004 and direct the respondents to release earned leave encashment for 84 days standing to the credit of the petitioner at the time of resignation in accordance with the Guru Nanak Dev University Calendar Rules.
