Petitioners seek a writ in the nature of mandamus to restrain the defendants from constructing a road above the plinth level of the houses of local inhabitants of Azad Nagar, Kurukshetra. It appears that during the pendency of this petition, a Local Commissioner was appointed vide order dated 31.03.2017. He has already submitted his report. Petition is disposed of with the direction to respondents no. 2 & 3 to look into the matter in light of the report submitted by the Local Commissioner. In case, it is found that parties are at variance with regard to their respective stand, petitioners shall be at liberty to avail the remedy of civil suit so that issue can be decided by way of leading evidence.
