(Oral) The petitioner has approached this Court under Articles 226/227 of the Constitution of India, seeking quashing of the impugned notice dated 13.04.2017 (Annexure P-10) issued under Section 13(2) of the Securitization and Reconstruction of Financial Assets and Enforcement of Securities Interest Act, 2002 (in short 'the Act'). Further, a writ of Mandamus has been sought for directing respondent No.2 to restore the possession of the mortgaged property as per the share of the petitioner and also to take a decision on the applications/representations dated 16.03.2015, 16.11.2015 and 08.02.2017, submitted by the petitioner for withdrawing as a guarantor/mortgagor/surety in the CC Limited (Credit Facility A/c No. 31703590024).

After arguing for sometime, learned counsel for the petitioner submitted that he may be allowed to withdraw the present writ petition with liberty to the petitioner to take recourse to the alternative remedies as are available to him, in accordance with law.

Dismissed as withdrawn. It shall, however, be open to the petitioner to take recourse to the remedies as may be available to him, in accordance with law.
