The petitioner through instant petition under Articles 226/227 of Constitution of India is seeking direction to respondent No. 2 to re-issue his passport.

An FIR No. 91 dated 08.05.2016, under Sections 323 and 325 of IPC was registered against the petitioner at Police Station, Nakodar, District Jalandhar. The police after completing investigation has filed its report under Section 173 Cr.P.C. before trial court. The matter is still pending before trial court.

As per Notification No. 570 dated 25.08.1993 issued by Central Government in exercise of power conferred by Section 22 of PARAMJIT KAUR SAINI 2023.08.03 15:59 I attest to the accuracy and authenticity of this order/judgment

CWP-16626 of 2023 -2- 2023:PHHC:099507 Passport Act, 1967, an applicant seeking issuance of passport against whom criminal proceedings are pending is supposed to approach trial court and seek permission.

On being confronted with aforesaid Notification, learned counsel for the petitioner seeks liberty to approach trial court, in terms of aforesaid Notification.

The petition stands disposed of with liberty to the petitioner to approach trial court, in terms of Notification No. 570 dated 25.08.1993. The trial court is requested to decide application of the petitioner after considering Notification No. 570 dated 25.08.1993.
