The present petition has been filed under Section 482 Cr.P.C praying for quashing of FIR No.0015 dated 13.3.2022 registered under sections 406, 498-A, 506 & 34 IPC at Police Station, Women Gurgaon, District Gurugram along with all the subsequent proceedings arising therefrom.

Having argued the matter at some length, learned counsel for the petitioner prays for withdrawal of the present petition qua his first prayer for quashing of the FIR with liberty to the petitioner to avail the alternate remedies as may be available in accordance with law. Prayer is allowed.

The present petition is dismissed as withdrawn qua the prayer for quashing of FIR with liberty aforesaid.

The second prayer made in the present petition is for quashing the Look Out Circular issued by the investigating agency against the petitioner.

Learned counsel for the petitioner submits that the petitioner is a senior citizen, who is presently living at Amsterdam, Netherlands. CRM-M-39823-2022 -2however, there is an apprehension of being arrested as the Look Out Circular has been issued against him. He very fairly submits that some protection may be granted to the petitioner enabling him to appear before the court of competent jurisdiction. He submits that petitioner would return to India by 31.1.2023. He further submits that the wife of the petitioner has also been granted protection from arrest by this Court vide order dated 24.8.2022.

Keeping in view of the peculiar facts and circumstances of the case and the submissions made by counsel, present petition is disposed of qua the second prayer regarding quashing the Look Out Circular issued against the petitioner, with a direction that in case the petitioner returns to India by 31.1.2023 and appears before the court of competent jurisdiction with an appropriate application for bail, he would have a protection from arrest for a period of 10 days from the date of his arrival in India. The Court concerned would deal with the application if any filed by the petitioner and decide the same expeditiously in accordance with law.
