MANJARI NEHRU KAUL, J. (Oral) The instant petition has been filed for grant of regular bail to the petitioner in case FIR No. 226 dated 13.11.2018 under Sections 302, 148, 149 IPC registered at Police Station Lopoke, Districe Amritsar Rural. Learned counsel contends that till today only 03 out of the 22 prosecution witnesses have been examined. He submitted that similarly situated co-accused have since been extended the concession of regular bail vide orders dated 09.07.2020, 13.08.2020 and 30.10.2020 passed in CRMM-16275-2020,CRM-M-21460-2020 and CRM-M-32982-2020 respectively (Annexures P4, P5 and P6). Thus, it has been prayed that the petitioner be also granted the concession of regular bail as he is behind bars since 08.07.2019.
Per contra, the learned State counsel, on instructions from ASI Kulbir Singh, has conceded that the petitioner is similarly situated as the SONIA BURA 2020.12.02 17:14 I attest to the accuracy and integrity of this document chandigarh

In view of the submissions made by the learned counsel and keeping in view that the petitioner has been in custody since 08.07.2019 and no useful purpose would be served by keeping the petitioner behind bars as the trial is unlikely to conclude in the near future, I deem it a fit case to grant the concession of regular bail. The petition is allowed and the petitioner is admitted to bail to the satisfaction of trial Court/Duty Magistrate. However, it is made clear that any observation made herein shall not be construed as an expression of opinion on the merits of the case.
