(Oral) Even though, reply has been filed, but the counsel for the respondent submits that he has no objection, if the transfer application is allowed and the divorce petition is transferred from Panipat to Patiala. The applicant-wife has filed the present application for seeking transfer of the petition under Section 13 of the Hindu Marriage Act i.e. DMC/45/2023, titled 'Nagesh Dhingra Vs. Chinky Dhingra', filed by the respondent-husband, pending in the Family Court, Panipat and she seeks transfer of the same to the Court of competent jurisdiction at Patiala. In view of the statement made by the counsel for the respondent, it is pertinent to mention that one daughter was born from the said wedlock, who is aged about 6 years and is in the care and custody of the Anu 2025.03.29 11:04 I attest to the accuracy and authenticity of this document Chandigarh

TA-974-2023 applicant. The applicant is also stated to be not working and as such, has no source of earning and is totally dependent upon her parental family. The distance between Panipat and Patiala is about 120 kilometres. There are already two cases, pending in the Courts at Patiala, on account of this matrimonial dispute.

Considering the aforesaid circumstances and also considering the statement made by the counsel for the respondent, the transfer application is allowed and the petition under Section 13 of the Hindu Marriage Act i.e. DMC/45/2023, titled 'Nagesh Dhingra Vs. Chinky Dhingra', filed by the respondent-husband, stands transferred from the Family Court, Panipat, to the Court of competent jurisdiction at Patiala. The requisite record of the aforesaid case be sent by the Family Court, Panipat, to the District and Sessions Judge, Patiala.

Learned District and Sessions Judge, Patiala, shall assign the said petition to the Family Court, Patiala. Even, the parties are directed to appear before the Family Court, Patiala, within a period of one month from today onwards.
