Present petition is a first anticipatory bail application where the petitioner apprehends his arrest in respect of offences punishable under sections 406, 420 IPC in FIR No.198 dated 22.06.2024 registered at Police Station Israna, District Panipat.

The allegations are of cheating and criminal breach of trust to the extent that complainant alleges that she being a woman, who is the cousin sister of the petitioner-accused is alleged to have given certain pieces of her jewellery to the petitioner to assist him in getting rid of financial crisis being faced by petitioner's business. The said jewellery was given sometime in 2016. 3.

It appears that there is some misunderstanding between the petitioner and the complainant who are closely related, and therefore, they fell apart which led to lodging of FIR on 22.06.2024.

This Court while granting interim anticipatory bail to the petitioner, directed the parties to explore the possibility of settlement in the matter through mediation.

Despite lapse of more than one year, the parties have not been able to come to terms and the Mediator, Dr. Pankaj Nanhera, who was present in the Court, has informed that he has made several sittings with the rival parties but to no avail.

Be that as it may, one of the reasons why the Court below had rejected the anticipatory bail application of the petitioner vide order dated 16.07.2024 was that the bail applications of other co-accused had also been dismissed. The petitioner has brought on record orders of this Court granting anticipatory bail to the other co-accused namely Bhavneet Kaur Alang, Balbir Singh and Savitri Devi, who have since been granted anticipatory bail by this Court vide Annexures P-8, P-9 and P-10 respectively. 7.

However, learned counsel for the State informs that the petitioner has not yet joined investigation, which understandably is attributed to the stay order granted by this Court during pendency of mediation proceedings. 8.

Considering the aforesaid fact that the entire offence appears to arise more out of impulse and intent, this Court is inclined to grant anticipatory bail to the petitioner, subject to his furnishing personal bond in the sum of Rs.1,00,000/- with two sureties of Rs.50,000/- each to the satisfaction of Arresting/Investigating Officer.

This order shall also remain subject to the following condition:- The petitioner shall plant 10 saplings of indigenous plants at a public place and submit proof in that regard by way of photographs before the concerned Police Station where the

CRM-M-36238-2024 3 FIR has been registered within a period of 15 days and if there is no such intimation submitted or intimation is found to be incorrect, then the State can move an application for cancellation of his bail.

The petition stands disposed of accordingly.
