The prayer in the present petition is for grant of regular bail to the petitioner in case bearing FIR No.284 dated 10.12.2019 under Section 22 of the Narcotic Drugs and Psychotropic Substances Act, 1985, registered at Police Station Canal Colony, Bathinda, District Bathinda. Learned counsel for the petitioner submits that the petitioner was sitting behind the Scooty and was apprehended with one Pankaj Batra. The alleged recovery effected from the petitioner is 840 tablets of Clovidol100 SR and the petitioner is in custody since 10.12.2019. Even the consent Memo has also not been signed by the accused-petitioner. Learned State counsel, though has not disputed the recovery part from the petitioner, but states that the charges are yet to be framed in MONIKA 2021.03.18 17:09 I attest to the accuracy and integrity of this document

I have heard the learned counsel for the parties. The petitioner has been in custody since 10.12.2019. The trial will take time to conclude because of COVID-19 pandemic. Moreover, the evidence has not yet been started. No useful purpose would be served by keeping the petitioner behind the bars.
Without commenting anything on the merits of the case, the petition is allowed and the petitioner is ordered to be released on bail on his furnishing bail/surety bonds to the satisfaction of the trial Court/Duty Magistrate.
