(Oral) By way of present writ petition filed under Article 226 of the Constitution of India, petitioner has approached this Court, seeking direction to the respondents, who have, despite declaring the petitioner to be the highest bidder on the opening date, neither communicated their rejection nor acceptance to the petitioner, even otherwise, during the currency of the offer made by the petitioner, sold a substantial quantity of the material (subjectmatter of tender) through auction. 2.

Learned counsel for the respondents states that the tender in pursuance to which the bids were invited has since been cancelled and thereafter, a fresh tender was floated and in pursuance to the fresh tender, the goods have been sold.

In such a situation, learned counsel for the petitioner states that he may be allowed to withdraw the present writ petition. 4.

Dismissed as withdrawn.
