***** Rajan Gupta, J. (Oral) Due to prevailing situation of COVID-19, matter has been heard through Video Conferencing.

Petitioner has sought a writ in the nature of mandamus to direct the respondents to decide his legal notice, Annexure P-12 as per law. Learned counsel for the petitioner places reliance upon a judgment titled as 'Balwinder Singh versus State of Punjab and others' (CWP-9291-2006 decided on 23.11.2006)'. In view of same, petitioner seeks refund of Motor Vehicles Tax and Penalty levied for the period when the petitioner was not having such carriage permit and claims that he was not operating during the said period.

At the outset, learned State counsel submits that legal notice, Annexure P-12 shall be considered and a speaking order shall be passed at the earliest by the competent authority in any case, not later than two months. Learned counsel for the petitioner is satisfied with this statement. In view of the above, no further adjudication of the matter is necessary. Petition is hereby disposed of.
