(Oral) The petitioner is seeking issuance of writ in the nature of mandamus for directing the respondents to appoint on the post of Mali in pursuance of the advertisement No. 5/2013 by giving benefit of instructions dated 02.07.2010 and 23.05.2014 (P-3 and P-4 respectively) The grievance of the petitioner is that once under same category post is unfilled (BC-B-ESM), the same has to be filled through the same category candidate and the case of the petitioner is covered vide instructions of the Haryana Government dated 02.07.2010 and 23.05.2014 (P-3 and P-4 respectively).

C.W.P No. 498 of 2016 -2given in this regard by the respondents and thereafter, the petitioner given legal notice 07.04.2015, which is also pending. Learned counsel for the petitioner states, that at this stage, the petitioner will be satisfied, if directions are issued to respondents to decide the legal notice, referred to above.

In view of above, without commenting on the merits of the case, this petition is disposed of with a direction to the respondents to decide the legal notice dated 07.04.2015 (P-6) of the petitioner by passing a speaking order expeditiously, in accordance with law, preferably, within a period of three months from the date of receipt of certified copy of this order.
