The instant petition has been filed by the petitioner under Section 439 of the Code of Criminal Procedure, 1973 seeking regular bail in case FIR No.368 dated 24.06.2023, under Section 323 IPC, 1860 and Sections 6, 17 of Protection of Children from Sexual Offences Act, 2012, registered at Police Station Mahesh Nagar, District Ambala Cantt. (Annexure P-1).

Learned State counsel has filed custody certificate of the petitioner dated 02.09.2024, reflecting his period of custody as 01 year 02 months and 03 days, which is taken on record.

Learned State counsel has informed that as per the Aadhaar Card, the date of birth of the prosecutrix is 01.01.2011. It has been further informed that the minor prosecutrix, who is aged 14 years, has delivered a baby and the FSL Report, Madhuban, Karnal dated 28.03.2024, is against the petitioner. 4.

After arguing for some time, learned counsel for the petitioner wishes to withdraw the present petition.

Accordingly, the present petition stands dismissed as withdrawn. 6.
