ARVIND SINGH SANGWAN, J. (Oral) The petitioner prays for grant of regular bail under Section 439 of the Code of Criminal Procedure (in short 'Cr.P.C.') in FIR No.107 dated 17.06.2019, for offence punishable under Sections 419, 420, 170, 171 of the Indian Penal Code (in short 'IPC') and 61 of the Punjab Excise Act, registered at Police Station City Dhuri, District Sangrur.
Counsel for the petitioner has submitted that the petitioner is in custody since 17.06.2019 and all the offences are triable by the Court of Magistrate. It is further submitted that challan stands presented and it will take long time in conclusion of the trial. Counsel for the State, on instructions from ASI Harminder Singh, has not disputed the factual position but opposed the prayer for bail on the ground that the petitioner is involved in 09 other cases under the Excise Act and he is a habitual offender. CRM-M No.33529 of 2019 considering the fact that the petitioner was arrested with 60 bottles of liquor and he is on bail in other pending cases; challan stands presented and conclusion of the trial will take some time, this petition is allowed and the petitioner is directed to be released on regular bail subject to his furnishing bail/surety bonds to the satisfaction of the trial Court/Illaqa Magistrate/Duty Magistrate.
However, it will be open for the prosecution to apply for cancellation of bail, if the petitioner is found involved misusing the concession of bail, in any manner.
