(Oral) The allegations against petitioner Tajinder Singh in this first bail application filed in case FIR No. 175 dated 11.7.2019 under Sections 323, 324, 354, 506, 341, 427, 34 IPC, Police Station City Kapurthala, have come about by a married lady aged around 35 years having two grown up children. In her allegations, she has alleged that she was regular visitor to a Gym where the accused too used to come and during the course of time they developed

-2friendship and subsequently accused-petitioner started stalking her and when he did not desist, the present case was got registered leading to the arrest of the petitioner on 11.7.2019. Learned counsel for the petitioner contends that the petitioner and the complainant are grown up and were in a relationship over a long period of time and has shown to the Court intimate photographs of the couple arguing that it is after their relationships have gone sour, the present case was got registered. Mr. Harbir Sandhu, AAG, Punjab on instructions from ASI Sukhdev Singh does not disputes the facts but has opposed the grant of bail submitting that if allowed bail, the petitioner might influence the trial.

Going through the submissions, on the face of the allegations and as is conceded by the two sides, the complainant is a grown up married lady and admits to be in a relationship which is substantiated by the photographs shown by the counsel for the petitioner. Thus, in the light of the same, culpability if any, shall be determined at the trial which is not likely to be concluded in near future, no purpose will be served by retaining the petitioner in jail. Accordingly, he is ordered to be released on regular bail to the satisfaction of learned Chief Judicial Magistrate/Duty Magistrate,

-3Kapurthala.

The present petition stands disposed off accordingly. The observations made herein above shall have no bearing on the merits of the case as these are purely for the disposal of the present bail application.
