Mr. V.K.Sandhir, Advocate for the petitioner. *** G.S.SANDHAWALIA, J. (Oral) The petitioner challenges her transfer order dated 20.2.2016 (Annexure P/1) from Gidherbaha to Malot.

Admittedly, the petitioner has not approached the authorities for redressal of her grievance as it is alleged that she has a medical issue and the discharge summary has been attached as Annexure P/3. It is further pleaded that the petitioner is to superannuate on 30.4.2017. It is settled principle as laid down by the Apex Court in State of U.P. Vs. Gobardhan Lal 2004 (2) RSJ 604 that transfer order is not normally to be interfered with unless it is challenged on the ground of malafides and violation of statutory provisions. Faced with this situation, counsel for the petitioner does not wish to press the present writ petition and prays that the same may be dismissed as not pressed with liberty to approach the authorities concerned for redressal of her grievance.

Accordingly, the present writ petition is dismissed as not pressed with the aforesaid liberty.

Needless to say that if any such representation is made by the petitioner, the authority concerned will take a decision within four weeks from the date of its receipt.
