Mr. C.S.Sharma, Advocate for the petitioners. *** G.S.SANDHAWALIA, J. (Oral) The petitioners seek the benefit of counting the qualifying service for grant of pensionary benefits with effect from the date of joining the Corporation instead of date of contribution to the provident fund. Reliance has been placed upon Civil Writ Petition No.8285 of 2004-Ved Parkash Vs. State of Punjab and others decided on 16.9.2010 (Annexure P/5), Letters Patent Appeal No.207 of 2011-P.R.T.C. Vs. Ved Parkash and another which was dismissed on 3.2.2011 (Annexure P/6). It has been pleaded that the SLP filed by P.R.T.C. also stands dismissed on 12.1.2012 and also in view of the judgment in Civil Writ Petition No.4453 of 2012-Gurdial Singh and others Vs. P.R.T.C. and another decided on 12.3.2012 (Annexure P/8).

Counsel for the petitioner submits that the petitioners sent a legal notice dated 9.1.2016 (Annexure P/9) and he would be satisfied if a direction is issued to the respondents to decide the said legal notice within some fixed time frame.

Keeping in view the limited relief sought by the petitioners, this Court is of the opinion that there is no requirement of calling for any reply on behalf of the respondents.

Civil Writ Petition No.5099 of 2016 -2Accordingly, without commenting upon the merits of the case, the present writ petition is disposed of with a direction to respondent no.2 to decide the said legal notice dated 9.1.2016 (Annexure P/9) within a period of three months from the date of receipt of a certified copy of this order. In case any adverse order is to be passed then a reasoned order be passed by the said respondent and be conveyed to the petitioners. The present writ petition is disposed off with the aforesaid directions.
