-.- AMIT RAWAL J. (ORAL) Concededly, petitioner was out of job. He was ordered to be reinstated vide award dated 16.11.2011 passed by Labour Court without granting benefit of continuity of service. Case of petitioner in present case is for regularization w.e.f. 1990 as per 2003 Policy.
Learned State counsel submitted that Policy of 2003 is not applicable to case of petitioner, as only such daily wages employees, who completed three years service on Group D post on 30.09.2003 were entitled for regularization. Once petitioner was not in job at that relevant point of time, he could not be granted benefit of regularization.
Needless to say that petitioner's case may be covered under 2014 Policy, which is pending adjudication before the Hon'ble Supreme Court.
