Paras Ram Sarpanch v. State Of Punjab And ORS
IN THE HIGH COURT FOR THE STATES OF PUNJAB AND
HARYANA AT CHANDIGARH CWP No.2627 of 2017 Date of Decision.14.02.2017 Paras Ram .......Petitioner Vs State of Punjab and others ........Respondents
Present:
Mr. I.S. Brar, Advocate for the petitioner.
Mr. Nakul Sharma, Advocate for the caveator-respondent No.3.
CORAM:HON'BLE MR. JUSTICE AMIT RAWAL -.- AMIT RAWAL J. (ORAL) The challenge in the writ petition is to the impugned orders (Annexures P-1 and P-2) whereby the petitioner has been suspended from the post of Sarpanch and facing the regular enquiry. The contention of the petitioner is that the enquiry is pending from 17.09.2015, in essence, it has not made any headway for the petitioner whereas the DDPO has been directed to hold the election. The tenure of the Sarpanch is going to expire in 2018 and pendency of the enquiry itself is a delaying tactic and therefore, he would be satisfied in case the appropriate direction is issued to the enquiry officer to conclude the pending enquiry expeditiously. The aforementioned prayer of the petitioner is fair and honest. Resultantly, the writ petition is disposed of with a direction to the Enquiry Officer to conclude the enquiry pending since 2015 as expeditiously as possible and preferably within a period of four months from the date of receipt of certified copy of this order.
