(ORAL) Through the instant petition, the petitioner seeks anticipatory bail in case FIR No. 76 dated 16.5.2019, registered under Sections 407, 379 IPC, Police Station Chheharta, Amritsar.

Learned counsel for the petitioners contends that petitioner No. 1 is the whistle-blower, who has got recorded the present FIR because on 11.5.2019 at about 4.00 P.M., his driver Amanpreet Singh @ Aman had taken away the truck loaded with 600 wheat bags. Learned State counsel submits that the alleged occurrence took place on 11.5.2019 at about 4.00 P.M, whereas the petitioner lodged the complaint on 16.5.2019. The investigating agency had investigated regarding the authenticity of accused Amanpreet Singh @ Aman son of Basant Singh resident of village Pakhoke from the said village but no such GURPREET SINGH 2019.11.18 17:27 I attest to the accuracy and authenticity of this document chandigarh person was found in village Phakhoke. CRM-M No. 33930 of 2019 -2also scrutinized the details of the toll plazas but movement of the truck in question was not found there.

In the present case, the FIR in question was got registered by petitioner No. 1-Bachittar Singh himself against his employee Amanpreet Singh @ Aman regarding the theft of his truck bearing No. PB-02-BM-9675 loaded with 600 wheat bags. However, upon investigation, the police found that petitioner No. 1 Bachittar Singh had given a false information in order to misappropriate 600 wheat bags in connivance with petitioners No. 2 and

Thereafter DDR No. 38 dated 5.7.2019 was registered by the police and during investigation, it was found that there was no person namely Amanpreet Singh @ Aman residing at the address given by petitioner No. 1. The allegations levelled against the petitioners are serious in nature. No ground for grant of anticipatory bail to the petitioners is made out.

The petition is dismissed.
