(ORAL) The grievance which is being raised by the petitioner is that the punishment imposed vide order dated 28.05.2015 (Annexure P-4) is excessive, keeping in view the charges alleged against him. Counsel for the respondents states that the order impugned before this Court is appealable before the higher authorities under the regulations and therefore, rather than approaching the appellate authority, the petitioner has approached directly to this Court without availing the remedy of appeal before the appropriate authority.

Counsel for the petitioner states that keeping in view the objection raised on behalf of the respondents, he may be allowed to withdraw the present writ petition with liberty to file an appeal against the impugned order before the appropriate authority. CWP-5153-2016 -2Counsel for the petitioner further states that as the present writ petition was filed in the year 2016 and in genuine belief, the present remedy of writ petition was being availed, the appeal to be preferred by the petitioner before the appellate authority be decided on merits and not be dismissed on account of the limitation.

Counsel for the respondents states that in case any appeal is preferred by the petitioner, the same will be decided on merits and will not be dismissed summarily by raising the objection qua the limitation.
