ARUN MONGA, J. (ORAL) Matter was taken up for hearing on 28.02.2023 and following order was passed :

"

As per office report, respondent No.10 has died and no steps have been taken to implead her legal representatives. Learned counsel for appellants appears and seeks time to contact the appellants to ascertain if anything survives in instant appeal.

At her request, adjourned to 09.05.2023."

On resumed hearing today, learned counsel for appellants appears and states that his attempts to contact the clients has turned futile and as such, he pleads lack of instructions. It seems that by sheer effluxion of time as the appeal is pending for the past more than 14 years, appellants have lost interest in pursuing the appeal. Be that as it may, instant appeal is dismissed for nonprosecution with liberty to revive the appeal as and when appellants contact their counsel.
