(ORAL) Apprehending his arrest in FIR No.111 dated 27.06.2023, registered for offences punishable under Sections 452, 324, 323, 427, 148, 149 of the Indian Penal Code, 1860 at Police Station Sadar Jagraon, District Ludhiana Rural, the petitioner has preferred this petition under Section 438 Cr.P.C. seeking pre-arrest bail.

The petitioner was granted indulgence vide order dated 2nd of August, 2023. On 6th of December, 2023 this Court was informed that offence committed by the petitioner has been opined to be grievous in nature and the same stands enhanced to Section 326 IPC. Counsel for the petitioner submits that the petitioner has joined the investigation.

CRM-M-37399-2023 However, State counsel opposes the bail plea by submitting that the petitioner gave gandasa blow on the head of the victim. The injury caused has been found to be grievous and on the basis of the medical opinion Section 326 IPC has been added.

I have heard counsel for the parties and have gone through records of the case.

Keeping in view the serious allegation against the petitioner of having caused grievous injury on the head of the victim, this Court does not find it to be a case for grant of discretionary relief of pre-arrest bail. Resultantly, the same is dismissed.
