Govind v. State Of Haryana
IN THE HIGH COURT OF PUNJAB AND HARYANA AT CHANDIGARH
CRM-M-40075-2020 DATE OF DECISION: 07.12.2020 GOVIND ... Petitioner (s)
Versus
STATE OF HARYANA ... Respondent(s) CORAM: HON'BLE MR. JUSTICE ANUPINDER SINGH GREWAL
Present:
Mr. Rajesh Lamba, Advocate for the petitioner.
Mr. Arun Beniwal, DAG, Haryana.
**** ANUPINDER SINGH GREWAL, J. (ORAL) The petitioner is seeking regular bail in FIR No.16 dated 20.01.2019, under Sections 406, 410, 420, 467, 468, 471, 120-B & 506 IPC, registered at Police Station Bhondsi, District Gurugram, Haryana. Learned counsel for the petitioner contends that the allegations in the FIR are that the petitioner has duped the complainant for a sum of Rs.10,70,000/- on the pretext of advancing her interest free loan of Rs.6 lakh. He, however, contends that the FIR was registered on the basis of a misunderstanding which has now been resolved and the matter has been compromised. He has filed a copy of an affidavit of the complainant through email in this regard which is taken on record. He further contends that the petitioner is in custody for about 5 months.
Learned State counsel upon instructions from ASI Vinod Kumar contends that challan has been filed.
CRM-M-40075-2020 Heard through video conferencing.
In view of the submissions of the learned counsel for the petitioner, especially when the petitioner is in custody for about 5 months, the matter has been compromised, the COVID-19 pandemic and the conclusion of the trial is likely to take some time, I deem it a fit case to grant the concession of regular bail to the petitioner.
Therefore, without expressing any opinion on the merits of the case, the instant petition is allowed. The petitioner is ordered to be released on regular bail on his furnishing requisite bonds to the satisfaction of the trial Court/Duty Magistrate concerned.
(ANUPINDER SINGH GREWAL) JUDGE 07.12.2020.
