PARAMJEET SINGH DHALIWAL, J. (ORAL) Instant writ petition under Articles 226/227 of the Constitution of India has been filed for issuance of a direction to respondents No.1 to 3 to protect the life and liberty of the petitioners at the hands of respondent No.4 - Mahesh Kumar, Inspector/SHO, Police Station Ferozepur Jhirka, District Mewat.
I have heard learned counsel for the parties and perused the record.
Learned counsel for the petitioners submits that petitioners have been found innocent in case FIR No.167 of 2014 registered under Sections 148, 149, 323, 324, 506 IPC at Police Station Ferozepur Jhirka and challan has already been presented. -2CWP No.6053 of 2015 Section 319 Cr.P.C. has been filed for summoning the petitioners as accused in the aforesaid FIR. However, in spite of this, respondent No.4 is harassing and asking the petitioners to appear before him time and again.
Learned counsel for the State states that petitioners are not being unnecessarily summoned or asked to sit in the police station. I have considered the contentions of the learned counsel for the parties.
In view of the statement made by learned counsel for the State, this petition has been rendered infructuous.
Disposed of as infructuous. Once the petitioners have been found to be innocent in the aforesaid FIR, they can only be summoned by the investigating officer if required for further investigation under Section 173 Cr.P.C.
