*** ARUN MONGA, J. (ORAL) Petitioner herein inter alia seeks issuance of a writ in the nature of mandamus directing respondent No.2 to decide his appeal dated 20.04.2021 (Annexure P-3) preferred by him against the order of 'dismissal from service' dated 26.03.2021 (AnnexureP-2) passed by respondent No.3 in a time bound manner.

Learned counsel for the petitioner submits that petitioner was issued charge-sheet dated 02.11.2020 (Annexure P-1). Pursuant thereto departmental inquiry was conducted against the petitioner. The inquiry officer found the petitioner guilty of all the charges levelled against him. Vide order dated 26.03.2021 (Annexure P-2) he was awarded punishment of 'dismissal from service'. Thereafter, petitioner filed an appeal dated 20.04.2021 (Annexure P-3) before respondent No.3.but the same is still pending till date, despite a reminder dated 05.08.2021 to decide the same. Hence, the instant petition.

I have heard learned counsel for the petitioner and gone through the case file.

Given the nature of order being passed, there is no necessity to seek return/response of the respondents as no further proceedings and/or pleadings are required.

Without commenting anything on the merits of the case, writ petition is disposed of, being pre mature, with observation that it is expected of the competent authority to decide the pending appeal, either way, in accordance with law, within a period of two months from today, since the same has already been pending for more than 05 months and livelihood of the petitioner is at stake.
