On 18.03.2016, the following order was passed:- "

The petitioner who was working as Sub Fire Officer has been reverted two steps below from the post of Sub Fire Officer to the Post of Fireman inter alia on the ground that there were no sanctioned posts of Sub Fire Officer and Leading Fireman.

Learned counsel for the petitioner draws the attention of this Court to letter dated 09.12.2015 (Annexure P-7) from the Director Urban Local Bodiescum-Fire Service Haryana, Panchkula to the Deputy Commissioner, Mewat (Nuh) which shows four sanctioned posts of Leading Fireman in Nuh and three sanctioned posts of Leading Fireman in Ferozepur Jhirka. On the basis thereof, learned counsel for the petitioner submits that as per seniority, the petitioner was PARAMJIT KAUR SAINI 2025.03.04 04:57 I attest to the accuracy and integrity of this document

CWP No. 5242 of 2016 (O&M) -2- entitled to be adjusted against one of the aforementioned sanctioned posts, both as Leading Fireman and Sub Fire Officer.

Notice of motion for 02.05.2016.

Mr. Harish Rathee, Senior DAG, Haryana, who is present in Court, accepts notice on behalf of respondents No.1 and 3 and prays for time to file written statement. Respondents No.2 and 4 are permitted to be served by way of dasti process.

Learned counsel for the petitioner undertakes to supply three copies of the writ petition to Mr. Harish Rathee, Senior DAG, Haryana, during the course of the day.

Till the next date of hearing, operation of the impugned order dated 07.02.2016 (Annexure P-5) is stayed."

Mr. Viren Nehra, Advocate submits that petitioner on attaining the age of superannuation retired on 31.03.2020. 3.

Ms. Palika Manga, DAG, Haryana does not dispute the aforesaid fact.

In view of interim order dated 18.03.2016, the petitioner continued to work as Sub Fire Officer. He is superannuated. 5.

In the backdrop, interim order dated 18.03.2016 is hereby made absolute.

Petition stands disposed of.
