PANKAJ JAIN, J. (ORAL) Present writ petition has been filed under Article 226/227 of the Constitution of India seeking issuance of writ in the nature of mandamus directing the respondents for initiating specific procedure for completion/resumption of selection process regarding filling up vacant posts from the candidates in the waiting list which was drawn in the year 2006.

Respondents vide public notice invited applications for direct recruitment for 1061 posts of General Duty Constables. The petitioners claim that they participated in the same. Admittedly, they were not in the merit list. As per the pleadings raised in the writ petition, the specific averment is that the petitioners were placed in the waiting list. Keeping in view the fact that more than 70 candidates did not appear, the posts which were left vacant ought to have been filled from the candidates in the waiting list including the petitioners.

Admittedly, the select list and the selection were effectuated in the year 2006. The first effort made by the petitioners as per the record at Annexure P-3 is on 28th of December, 2010. Information was sought under RTI Act. Prayer was for supply of copy of the waiting list and the merit list. As per the petitioners the same was not responded to and they were made to run from pillar to post. Surprisingly again for 9 years the petitioners went dormant and now after 15 years they have woken from the slumber to claim that they be appointed, as the selected candidates failed to appear and join. 4.
In the considered opinion of this Court, this Court can not issue any direction to the respondents to operate waiting list which was casted about 17 years back. Keeping in view the facts and circumstances of the present case and the nature of the relief prayed for by the petitioners, the present writ petition is found to be without merit and is barred by delay and laches.
