HARINDER SINGH SIDHU, J Prayer is for grant of regular bail in case FIR No.46 dated 03.10.2013 under Section 22 of the NDPS Act registered at P.S Khemkaran District Tarn Taran.

As per allegations in the FIR, 1000 tablets of Diphenoxylate Hydrochloride were recovered from the conscious possession of the petitioner. Total weight of the recovered contraband is 74 grams. Learned counsel for the petitioner contends that the quantity of the seizure of the alleged contraband is marginally above the commercial quantity and that false recovery has been foisted upon the petitioner. Though, it is conceded that the petitioner was earlier declared proclaimed offender on 01.11.2016. He was arrested on 27.07.2019 and is in custody since then.

Heard.

Without commenting anything on the merits of the case and also bearing in mind the fact that the trial of the case is not making any headway due to Covid pandemic, in my opinion, no useful purpose will be served by detaining the petitioner behind bars any further.
