For the reasons recorded in the application, which is supported by an affidavit, the same is allowed and the matter is taken for hearing today itself.
Main case Prayer is for grant of regular bail in case FIR No.237 dated 07.09.2020 under Sections 395,342,148,149 IPC registered at P.S Chattiwind, District Amritsar.
FIR was lodged on the statement of one Parminder Singh, who stated that he alongwith his cousin Paramjeet Singh was running a shop by the name of Baba Marble, opposite Best Price where they were selling marble and floor tiles. CRM-M-39591 of 2020 (O&M) #2# home after closing the shop. It is alleged that on the night intervening 6/07.09.2020, some unidentified persons entered the shop after scaling the wall. They were armed with kirpans and dandas. They locked the Chowkidar Garbu in a room and took the key of gate from him. After opening the main gate, they brought a tractor trolley inside and stole boxes of flooring tiles and took them away on the tractor trolley. It was noticed that 300-350 flooring tiles were missing.
It has come on record that out of 10 accused, nine have been arrested. From co-accused Jivan, 50 boxes of tiles, from co-accused Patras Masih,140 boxes of tiles and kirpan whereas 50 boxes of tiles with one LED having been recovered from the present petitioner. The petitioner has been in custody since 04.09.2021. The investigation is complete and challan has been filed. Without commenting anything on the merits of the case and also bearing in mind the fact that the trial of case is likely to take sufficient time to conclude, in my opinion, no useful purpose will be served by detaining the petitioner behind bars any further. The petition, as such, is accepted. The petitioner Lovejit Singh @ Labba is ordered to be released on bail on her furnishing bail bonds/surety bonds to the satisfaction of learned trial Court/Chief Judicial Magistrate/Duty Magistrate concerned.
