(ORAL) Through this appeal, claimant has sought enhancement of compensation, modifying award dated 12.01.2010 of the Motor Accident Claims Tribunal, Gurdaspur (for short 'the Tribunal'). Both the sides are ad idem that this case has to be remanded to the Tribunal for fresh decision in view of the fact that insurer and owner of the offending vehicle were not impleaded as party before the Tribunal and have been impleaded for the first time in this appeal before this Court. Thus, they did not get any opportunity to defend the case. In view of above, case is remanded to the Tribunal for fresh decision after hearing both the sides.
