This petition has been filed by the petitioners under Section 438 Code of Criminal Procedure for grant of anticipatory bail in case FIR No.98 dated 30.06.2019 under Sections 307, 323, 324, 148 and 149 IPC, registered at Police Station Maqboolpura, District Amritsar. Learned counsel for the petitioners contends that petitioner No.1-Satinderbir Singh had already deposited his weapon on 29.03.2019 with the Army Gun House and, therefore, the allegations regarding firing are not believable. According to him, even otherwise no injury has been caused as a result of gun shot fired as it had hit the buckle of the belt of the victim. He further contends that the injury attributed to petitioner No.2 is on the non vital part of the body and, therefore, the petitioners deserve for concession of pre-arrest bail.

CRM-M-33849-2019(O & M) -2On the other hand, prayer is opposed by learned Stated counsel who has produced the MLR of the victim to contend that four injuries were suffered. According to him, allegations are serious and concession of prearrest bail does not deserve to be extended to the petitioners. After hearing of learned counsel for the parties, this Court finds that both the petitioners have been named in the FIR and specific role has been attributed.

Considering the nature of injuries suffered by the victim, this Court does not find it a fit case for pre-arrest bail. Dismissed.
