Prayer in this writ petition filed by the petitioner under Articles 226/227 of the Constitution of India, is for issuance of a writ in the nature of mandamus, directing respondent No.2 to confirm the petitioner as Driver under Regulation 10 of the Pepsu Road Transport Corporation (Conditions of Appointment & Service Regulations), 1981 and to grant the status and consequential benefits and to decide the legal notice dated 30.05.2017 (Annexure P-4).

Learned counsel for the petitioner confines his prayer for deciding the legal notice dated 30.05.2017 (Annexure P-4). He submits that at this stage, petitioner would be satisfied, if the said legal notice is considered and decided by passing a speaking order within a time bound frame.

Learned counsel for the respondents have no objection to the innocuous prayer made by learned counsel for the petitioner. 4.

I have heard learned counsel for the parties and have gone through the record of the case.

Without going into the merits of the case at this stage, the present petition is disposed of with a direction to respondent No.2 to consider and decide the legal notice dated 30.05.2017 (Annexure P-4) submitted by the petitioner by passing a speaking order, preferably within a period of 03 months from the date of receipt of certified copy of this order.
