The counsel for the petitioner brought to the notice of this Court that the other accused who faced trial in the present FIR have already been acquitted vide judgment dated 13.3.2019 by the Court of Sub-Divisional Judicial Magistrate, Siwani and copy of the same is Annexure P-7. ( 2 ) CRM-M-39805-2020 (O&M) Admittedly, the present petitioner was declared proclaimed person by the trial Court vide order dated 15.7.2017 and challenge laid to the said order was also declined by this Court vide order dated 31.8.2017. Still taking into consideration the fact that the co-accused Chota who faced trial has already been acquitted, the present petition is hereby disposed of with direction to the petitioner to surrender and to move regular bail application before the trial Court within next 30 days and the same is to be disposed of by the said Court within 3 days of its filing in accordance with law, while taking sympathetic view in the light of the judgment dated 13.3.2019 whereby co-accused Chota was acquitted.
